(This paper was prepared by the Institute for Family Advocacy & Leadership Development for the Community Services Appeals Tribunal as an amicus brief in relation to the appeal of the decision of the Minister for Disability Services to adopt a transition plan.) The paper reviews literature and best practice throughout Australia to demonstrate that all children, including those with high support needs, can be supported to be brought up in families. The paper also gives a historical perspective on the the reasons that children come into care. It gives examples of service systems and supports in Queensland, Victoria and South Australia that have resulted in the closure of congregate care facilities, with the children being either returned to their birth families or to other families.
